I'd like to thank Mayor Nutter for saving Christmas.

On Wednesday afternoon he announced that the city had overreacted in changing the name of the traditional German Christmas Village on Dilworth Plaza to simply "Holiday Village."

"Christmas Village" it will be once again.

And here I had been ready to bury the decision.

Why not? Pulling the word Christmas off the sign over the village gate seemed ridiculous on Tuesday afternoon when I walked around that dollop of Deutschland outside City Hall, sampling the hot nuts and sizzling bratwursts, and ogling the tiny elves and fat Santas.

After two years of trying, they'd finally built a pretty good Christmas market in Center City. Then they tried to paper over what it really was.

The name change struck me as way too P.C. as well as an offense to those who love language.

I stood in a media scrum Tuesday - news of the name change had made the Drudge Report - as city Managing Director Richard Negrin explained how he'd received complaints from city workers and residents about the market, how unwelcoming it was to those who don't do Christmas.

He told of how a little girl and her father had been walking by the market the other day, and the girl, who was Jewish, had asked, "Don't we get a village?"

Yes, dear, I thought. We call it New York.

So I was a little hostile. I was completely unbothered by a celebration of Christmas at City Hall, and was fully prepared on Thursday night, when the mayor was to light the "Holiday Trees," as they're called in a media release, to see more waffling in action.

Yes, it's the Christmas season. Get over it. I have.

San Francisco Leads Charge to Boycott Arizona, But Calls Could Spark Backlash

Sanctuary city San Francisco is leading the charge of municipalities and groups considering a boycott of Arizona over its law to allow police to ask people their immigration status.

Mayor Gavin Newsom this week suspended all non-essential travel for city employees going to Arizona, meaning no conference in Scottsdale next weekend for members of the city's housing authorities. The city's Board of Supervisors also has taken the first step toward an economic boycott, a move that could result in the suspension of existing contracts with Arizona-based companies and a ban on new ones.

But Newsom also has formed an "Arizona Boycott Workgroup” to analyze if and how an economic boycott could backfire on San Francisco businesses. For instance, the city does business with a company that accepts and processes payments in Arizona. There's concern if the boycott is made uniform, 2,500 San Franciscans could lose their jobs.

Groups like the San Francisco Convention Bureau and the city's restaurant lobby also worry about a reciprocal backlash.

(Oct. 17) -- A Pennsylvania firefighter who put an American flag sticker on the front of his locker has been suspended without pay for refusing to take the Old Glory decal down.
James Krapf, along with nearly a dozen other Chester, Pa. firefighters, were ordered to remove personal items from the outside of their lockers -- a violation of department policy, MyFoxPhilly.com reported.

Hollyweird is Starting Already

So, the Bitter American was finally finishing yesterday's Inkwaster this morning when he came across yet another leftist-let's hold hands and sing Kum-Ba-Ya-Hollyweird diatribe.

Christopher Kelly bemoans the continued existence of racism and racists ideology in America's movies, specifically, Clint Eastwood's new "Gran Torino," in the Age of the Obamistake?

Kelly calls the movie "cringe-inducing" because Clintwood's character is "A grousing, growling racist from the Archie Bunker old school, (who) finds himself as the last white person still living on a now entirely Asian American street in a run-down neighborhood in Detroit."

Kelly then posits "In real life, of course, Walt would probably just sell his house and move. But this being a Hollywood movie, he stays put and finds moral redemption."

Well, guess what, Mr. Kelly? The Bitter American lives in a neighborhood that 10 years ago was mostly working-class Irish- and Italian-Catholic butted against a working-class Jewish neighborhood.

Today, its 99.44% black, and I'm the last white guy on my block. Why haven't I just pulled up stakes and moved? Well, in Mr. Kelly's distorted world, it must be really easy. For me, I've had to drop close to $10K over the past two years to repair and replace and repaint. I've taken a second job (albeit one for which I am well-compensated) and, hopefully, I'll be outta here in the late spring because I'll have finally saved enough to put down 20%. I'm funny that way,..I don't ask for charity or a loophole-filled, fingers-crossed mortgage! I want to be able to pay off my mortgage in a timely fashion and actually own my home someday.

But back to that mean, racist guy, Walt: Kelly goes on to state "Obnoxious and idiotic in equal measure, Gran Torino normally wouldn't be a worth a second thought. But it arrives in theaters seven weeks after President-elect Barack Obama instantly rewrote the narrative of race relations in the United States."

And thus is the crux of the Bitter American's bile blogging: The Obamistake DIDN'T rewrite the narrative of race relations. The MSM did it for him! Doesn't that just send a tingle up your leg?

No,...if America was ready to elect a person based on character and not color, Michael Steele would be a gentleman Senator from Maryland. But no one heard his platform because the NAACP was too busy throwing Oreo cookies at him.

So, this isn't a new era in race relationships in America, folks! Its the second coming of the Socialist Clintonian Utopia (SCU): where fighting and evil thoughts are illegal and where the leaders of our country will confront our enemies and talk themselves into a corner from which 9/11's spring forth.

And in order to get the American Everyman onboard with this philosophy, the MSM finds itself tasked with eliminating the expression of any ideology not in line with the SCU (and they bitched about Bush killing the First Amendment?)

Drama derives from conflict and if that means having a racist character at its center, so be it. If not, we are doomed to a world imagined in Vonnegut's "Harrison Bergeron," where "All men are not created equal. It is the purpose of the Government to make them so."

FCC gets complaints on Utley's on-air F-bomb

It was the F-bomb heard round the world . . . or at least the Philadelphia area.

And Phillies second baseman Chase Utley's use of the colorful adjective during the team's World Series victory parade on Oct. 31 has landed in the lap of the Federal Communications Commission.

The FCC reports it received 26 complaints from the public about Utley's language, which was heard live, in the late afternoon, on at least five television stations and one radio station, KYW (1060). Nielsen Media Research estimated that more than 825,000 local viewers saw part of the parade on CBS3, 6ABC, NBC10, Fox29, or Comcast SportsNet.

Whether any of the stations will face sanctions is not clear. An FCC spokeswoman said Tuesday that the agency does not comment on open issues.

The complaints - copies of which were requested by The Inquirer under the Freedom of Information Act - assign equal blame to Utley and the stations. The identities of the complainants were redacted.

"If they didn't want such words to be broadcast, they should have aired [it] on a delay to catch any obscene language," wrote a viewer from Philadelphia. "Pull their license to broadcast."

Another viewer wrote: "He should be disciplined for his lack of respect towards his fans and in particular the children exposed to such vulgarity. . . . The broadcasters are not at fault. Chase Utley is."

Another: "This was not a casual slip. This was an intentional misuse and abuse of the public airwaves. . . . How am I to explain such profanity to my child?"

And another: "It was embarrassing that he was allowed to do that and if there are no ramifications I will be furious. Is there no platform that is sacred anymore?"

Utley, who would not face sanctions himself, addressed his language Monday during a news conference about his surgically repaired hip: "I tell all kids not to use that word. If they're 29 and they win the World Series, I think they can say that. But I definitely would say to all the kids out there, 'Kids, it's a bad word. Don't say it. And I'm dead serious.' "

Anchors on most stations apologized after the speech, which was not subject to the delays common in talk radio. The stations themselves this week recalled receiving few if any complaints. The stations either declined to comment or did not respond to inquiries this week.

The case - the uttering of a fleeting expletive in a live setting - may become part of a battle between the FCC and broadcasters.

The audio and video in Citizens Bank Park, at the end of the parade, was provided by Comcast SportsNet under a pool arrangement to local broadcasters. SportsNet would not face sanctions because it is a cable network, not a broadcaster, and is not subject to FCC indecency rules.

SportsNet, which has made the parade video available through Comcast On Demand, recently edited out Utley's comment.

Anyway, this weekend brought about an abundeance of bad health news in the Trek Family.

First, Friend O' Trek Cpl Dave Toms, USMC - his father was recently diagnosed with stomach cancer. The good news was that it hadn't spread. The bad news was he underwent significant abdominal surgery, including the removal of his spleen and most of his stomach.

If that wasn't enough, last week, Dave's mother was driving his father to the hospital for a follow up due to an on-going infection. While driving to the hospital, some asshat blew a FOUR-WAY stop sign and T-boned the Toms-mobile! Mrs. Toms is in a trauma center with bilateral hip fractures, rib fractures and a concussion. She's looking at a LONG recovery road. Mr.Toms in back in the ICU and the outlook is not too encouraging.

Next, you'll remember the Trek-partner, Medic Mike (formerly of Orbs of Confusion before going to the darkside of MySpace). His father-in-law received a new heart today and is in critical condition. Mrs. Mike says he was thumbs-up after the surgery.

Segal’s Flight

The publisher of the Philadelphia Gay News joins a flock of prominent online voices in a fight against censorship.

When Philadelphia Gay News publisher Mark Segal first heard about the Child Online Protection Act (COPA), an Internet censorship law that many believe would run roughshod over the First Amendment, he couldn’t help but remember the 1980s.

(TM-Pro-gay internet content is OK,...anti-gay content destroys the First Amendment? WTF?)

“Back then our community had no other place to look for HIV/AIDS information on a regular basis,” Segal says. “The nongay press didn’t fully understand the research.” Segal founded the PGN specifically because he felt a responsibility to inform the LGBT community of issues often overlooked by mainstream media. Now Segal believes COPA would put his mission in serious jeopardy.

For that reason the Philadelphia Gay News recently joined an ACLU lawsuit against COPA along with a veritable who’s-who of online writers, publishers and activists—from websites like Salon.com and UrbanDictionary to individual writers like beat poet Lawrence Ferlinghetti.

(TM - The ACLU is involved in further diluting the power of the First Amendment? Go figure!)

“Because the name of the bill contains the word ‘child’ and the word ‘online,’ many mistakenly think this is about child pornography,” says Catherine Crump, staff attorney with the ACLU. “The material COPA prohibits is any material that anyone in the most conservative community may think is harmful to minors.”

A large section of the COPA law deals with definitions. Certain relative terms like “commercial purposes” (money is being earned) and “minor” (a person 17 or younger) must be specifically defined. But it’s the section on the vague term “harmful to minors” that has upset some of America’s most respected online voices.

The statute defines material harmful to minors as “any communication, picture, image, graphic image file, article, recording, writing or other matter of any kind that is obscene,” but goes on to qualify the statement, referring to material that “the average person, applying contemporary community standards, would find, taking the material as a whole and with respect to minors, is designed to appeal to, or is designed to pander to, the prurient interest.”

The law would also prohibit any material that “lacks serious literary, artistic, political or scientific value for minors.”

“‘Harmful to minors,’ ‘of the prurient interest’ —no one knows what any of those terms mean,” says ACLU staff attorney Chris Hansen. “What we do know is that there are large segments of the population who believe that any speech about homosex-uality or even sexual activity, except for abstinence, is inappropriate for minors.”

(TM - Umm,..if you don't understand those terms, ask your university to give you back your tuition, Chris!)

Because the case is still under litigation, the Justice Department declined to comment for this story. But according to its brief, the term “harmful to minors” is well-defined by past Supreme Court rulings.

“Plaintiffs contend that this definition is ‘hopelessly uncertain,’” the brief states. “Although some uncertainty may nevertheless exist regarding the precise application of this definition to specific material, the Supreme Court has never held that the First Amendment requires absolute certainty regarding what a jury may find obscene or harmful to minors.”

Instead the Justice Department says the practical application and the “legislative history” of COPA limits its scope.

Salon.com doesn’t agree. The website joined the lawsuit because of items collected in a congressional study of sexually related material pertaining to COPA. The brief speaks to its claims, saying, “plaintiffs cite excerpts from the website of plaintiff Salon, but the majority of the material collected there—ranging from articles about sexual experiences, to sexual cartoons, to images of nude or partially nude prisoners at Abu Ghraib—is plainly not ‘harmful to minors,’ either because it does not appeal to the prurient interest of minors or it has serious value for older minors.”

The Justice Department defines older minors as over the age of 15. But this distinction appears nowhere in the original COPA statute. These definitions are again explained away through “practical application” and “legislative history”—ideas the ACLU and its plaintiffs don’t place much stock in.

“Our clients do not find it comforting that the government says, ‘We could prosecute you under the law but we won’t; don’t worry about it,’” Hansen says. “This is a criminal statute with criminal penalties, so if you’re the Philadelphia Gay News and you don’t know what’s inappropriate under the law and you don’t want to go to jail, what do you do? You start self-censoring.”

For PGN, it might mean it wouldn’t be able to report on safe sex, the problems of LGBT youth, drug problems in the LGBT community, hate crimes or even the activities of the religious right because someone may take offense. Because of civil penalties and provisions, the PGN could be open to countless frivolous lawsuits simply for producing a newspaper and publishing it on the Internet.

But for Mark Segal, the issue is bigger than potential obstacles in publishing. “We are by our very name an advocacy newspaper fighting for LGBT equality and a community platform,” Segal says. He objects to any roadblocks LGBT teens and young adults face when seeking sexual health information.

“Any individual who is sexually active and has the knowledge to understand where to find information that will keep him or her healthy should not be denied that information,” he says. “The opposite is a health catastrophe.”

George Carlin, who died of heart failure Sunday at 71, leaves behind not only a series of memorable routines, but a legal legacy: His most celebrated monologue, a frantic, informed riff on those infamous seven words, led to a Supreme Court decision on broadcasting offensive language.

The counterculture hero's jokes also targeted things such as misplaced shame, religious hypocrisy and linguistic quirks — why, he once asked, do we drive on a parkway and park on a driveway?

Rutgers Women's Basketball Team OK With Imus' Return to Radio

Don Imus can do whatever he likes, including return to the radio airwaves.

That’s the feeling of the Rutgers women’s basketball players, whom Imus branded with a racial comment last winter.

The team and their coach, C. Vivian Stringer, received a standing ovation Monday night at the Waldorf Astoria in New York City from Billie Jean’s Women’s Sports Foundation. They also were presented with the Wilma Rudolph Courage Award for getting through the Imus episode with grace and dignity.

But when I asked player Essence Carson, who speaks for the team, if she minded Imus’ return, the tall beauty responded with aplomb.

"We never asked for his resignation in the first place," she said. "He can do whatever he wants to."

Would she consider being a guest on Imus’ new show, set for Citadel Broadcasting’s WABC in New York? Carson, no fool, just shook her head. She had more important things to think about.

Later I asked Stringer the same questions, but the famed coach just sort of whisked the air with her hand. A man she identified as director of sports for Rutgers said, "It’s all in the past."

So that’s it: Imus can return without fear of reprisal from the Rutgers women. But maybe their lack of protest just shows how classy they are. They certainly all looked good last night as ESPN produced the three-hour show at the Waldorf. Now if only the sports net would broadcast the show on its network or on Lifetime.

Rutgers Women's Basketball Player Files Lawsuit Against Don Imus

NEW YORK — A member of the Rutgers women's basketball team sued Don Imus and CBS on Tuesday, claiming the radio personality's sexist and racist comments about the team damaged her reputation.

Kia Vaughn filed the lawsuit alleging defamation of character in state Supreme Court in the Bronx the same day Imus settled with CBS Radio in a deal that pre-empts his threatened $120 million breach-of-contract lawsuit against CBS.

Vaughn's lawsuit, believed to be the first by a player in the case, says Imus and his former co-host Bernard McGuirk, along with CBS Corp. and CBS Radio, are legally responsible for damage done to her character and reputation. There is no dollar amount listed in the suit.

Vaughn's attorney, Richard Ancowitz, said: "The full effect of the damage remains to be seen."

"This is about Kia Vaughn's good name," Ancowitz said. "She would do anything to return to her life as a student and respected basketball player — a more simple life before Imus opened his mouth on April 4."

Imus referred to the basketball players as "nappy-headed hos" on his nationally syndicated radio program in April, becoming the target of heated protests led by the Rev. Al Sharpton. He was fired shortly after.

Programming Note!

As many Bloggers are finding out (Rachel for example) the politically correct environment that modern liberals have created can be a dangerous place. If you don't tow the politically correct line, your free speech rights can get squashed and you can find yourself in a jam PDQ. Wyatt knows exactly what I mean. Being public servants puts us into a category that is different than most folks. And within this category there are sub categories. If you don't fit into the proper category and you voice your opinion, and someone in charge doesn't like it, you put yourself and your livelihood at risk.

So I have a dilemma. I can quit Blogging for my family's sake. I'll have less of a chance of pissing anyone off and therefore keep my job. OR I can censor all of my remarks to make them non-offensive and politically correct. (I'd rather quit). The other option is to go underground. Change my name and edit my previous posts to remove anything that could potentially get me into trouble. As it is now it wouldn't be too hard to figure out who I am at work.

I could also turn the blog over to someone else. (Nah). So I think in the end I'm going to keep at it for a while longer. I'll see how it goes. One thing though: I'll be changing my screen name to CaptainAmerica from now on. Since I couldn't think of another good name (Tired) and he's been my favorite Super Hero and a running theme in my blog I figured it will work. Thanks to my twelve readers for your patience and support.
