Judge Rules Health Care Law Is Unconstitutional

A U.S. district judge on Monday threw out the nation's health care law, declaring it unconstitutional because it violates the Commerce Clause and surely reviving a feud among competing philosophies about the role of government.

Judge Roger Vinson, in Pensacola, Fla., ruled that as a result of the unconstitutionality of the "individual mandate" that requires people to buy insurance, the entire law must be declared void.

"I must reluctantly conclude that Congress exceeded the bounds of its authority in passing the act with the individual mandate. That is not to say, of course, that Congress is without power to address the problems and inequities in our health care system. The health care market is more than one-sixth of the national economy, and without doubt Congress has the power to reform and regulate this market. That has not been disputed in this case. The principal dispute
has been about how Congress chose to exercise that power here," Vinson wrote.

Olbermann Announces Departure from MSNBC

MSNBC host Keith Olbermann announced Friday that he is leaving the network and has taped his last "Countdown" show.

MSNBC issued a statement that it had ended its contract with the controversial host, with no further explanation. Olbermann hosted the network's most popular show, but his combative liberal opinions often made him a target of critics.

Olbermann did not explain why he was leaving.

"MSNBC thanks Keith for his integral role in MSNBC's success and we wish him well in his future endeavors," the network said. (That's corporate-speak for "Don't let the door hit you in the ass on the way out!")

A spokesman said Phil Griffin, MSNBC's president, would not comment on Olbermann's exit. (That's corporate-speak for "our lawyers had to explain 'libel' to me one time too many.")

During a late September gathering with voters to talk about jobs and the economy, Scott Turner of Richmond, Va., had something more elementary than the unemployment rate on his mind when he posed a question to President Obama:

"Is there any hope for us returning to civility in our discourse?" Turner asked.

Six weeks later — at the end of a bitterly fought campaign that ended poorly for Obama and the Democrats — a chastened president professed optimism. "I do believe there is hope for civility," Obama said. "I do believe there is hope for progress." (Yeah,...how's that "Hope and Change" thing working out for you now, Barry?)

To that end, Obama on Nov. 30 will host new congressional leaders for a private meeting at the White House. How it goes — particularly between Obama and incoming Republican House speaker John Boehner of Ohio — will set the stage for new congressional debates over a range of crucial issues: how to create jobs, whether to extend Bush-era tax cuts, challenges to the health care overhaul Democrats pushed through Congress this year, and more.

As the 2012 presidential campaign looms and the economy stays stagnant, political tensions are high amid profound disagreements over the role and size of government. Moderates in both parties are launching a new push for civility, but the loudest voices tend to come from the extremes. The Tea Party movement that helped Republicans take over the House and narrow Democrats' advantage in the Senate was inspired largely by conservatives angered by the growth of government, most recently under Obama.

Even after Obama issued his invitation to the White House meeting, Senate GOP leader Mitch McConnell of Kentucky said Republicans should focus on a starkly political goal: to "deny President Obama a second term."

"The gloves are off," University of Texas presidential historian Bruce Buchanan says. "Ultimately, politics is a substitute for war. ... Is civility impossible? No. Is it likely? No." (The gloves came off when the media took sides)

In the fall of 2009, Rep. Joe Wilson, R-S.C., stunned fellow lawmakers during Obama's speech to a joint session of Congress on his health care legislation. When the president said the government would not provide coverage for illegal immigrants, Wilson shouted out, "You lie!" from the floor of the House. (Well, SOMEONE had to do it!)

The Obamessiah spoke on the John Stewart Show last night and said:

Obama leaned in and pointed at the host. "Your suggestion was that it was timid."

Still, the president did not really quarrel with Stewart's notion that Obama has done some of his work in a "political manner that has papered over a foundation that is corrupt."


"I think that is fair," Obama granted.


But when Stewart moved, politely, to point out weaknesses in the health-care legislation, Obama pointed at him again. "Not true!" the president argued.


Obama wore a displeased grin as Stewart diagnosed, with high accuracy, the administration's condition: "The expectation, I think, was audacity going in there and really rooting out a corrupt system, and so the sense is, has [the] reality of what hit you in the face when you first stepped in caused you to back down from some of the more visionary things?"


"My attitude is if we're making progress, step by step, inch by inch, day by day," Obama said, "that we are being true to the spirit of that campaign."

Hmmm,..where have I heard that before?

Del. Senate Candidate Christine O'Donnell: 'I'm Not a Witch'

DOVER, Del. (AP) - Senate candidate Christine O'Donnell is trying to assure Delaware voters: "I'm not a witch."

The Republican tea-party-backed candidate in her first TV ad since winning the primary pokes fun at comments she made during a 1999 taping of a late-night talk show that she dabbled in witchcraft when she was a teenager.

In the 30-second ad that starts airing Tuesday, O'Donnell smiles at the camera and speaks over a soft piano soundtrack. "I'm nothing you've heard. I'm you."

The tea party-backed O'Donnell faces Democrat Chris Coons in November.

"It's surprising that Ms. O'Donnell, in her first television commercial, offers no solutions to the problems facing working families," said Coons campaign spokesman Daniel McElhatton. "There's no ideas here; there's no plan."

O'Donnell's comments about witchcraft were made during a taping of comedian Bill Maher's "Politically Incorrect" TV show.

"I dabbled into witchcraft. I never joined a coven," she said on the video, a clip of which hit the Internet just days after she stunned longtime congressman Mike Castle in last month's GOP primary in her third bid for Senate.

"One of my first dates with a witch was on a satanic altar, and I didn't know it. I mean, there's little blood there and stuff like that," she says. "We went to a movie and then had a little midnight picnic on a satanic altar."

In the ad, O'Donnell says, "None of us are perfect, but none of us can be happy with what we see all around us - politicians who think spending, trading favors and backroom deals are the ways to stay in office. I'll go to Washington and do what you'd do."

O'Donnell has made light of the witchcraft comments.

"How many of you didn't hang out with questionable folks in high school?" she asked fellow Republicans at a GOP picnic in southern Delaware last month.

Delaware Republican Senate nominee Christine O'Donnell on Sunday chalked up her experimentation in sorcery to being a teenager, saying there's no magical explanation to her 1999 confession that she "dabbled into witchcraft."

Speaking to Republican picnic-goers, the insurgent Tea Party candidate said she didn't doing anything differently than lots of kids at that age.

"I was in high school, how many of you didn't hang out with questionable folks in high school? But no, there's been no witchcraft since," she said, shrugging off her dalliances with the dark arts.

"Now let’s put that to rest and move on to what we’re going to do," she said.

If were going to talk about sorcery in government, let's talk about things like:

• Obamacare
• The stimulus lowering the deficit
• The stimulus lowering unemployment
• Etc, etc, etc

Sestak Defeats Specter in Pennsylvania Democratic Primary

Rep. Joe Sestak sent Pennsylvania Sen. Arlen Specter into retirement Tuesday with a stunning come-from-behind victory in the Democratic primary.

Specter becomes the third incumbent member of Congress in two weeks to lose his job, after Republican Sen. Bob Bennett lost the GOP nomination at the party's Utah convention and Democratic Rep. Alan Mollohan lost a primary in West Virginia.

In November, Sestak will face Pat Toomey, who won the Republican nomination.

Specter, after calling Sestak to congratulate him, delivered a concession speech in which he thanked his campaign and his supporters.

"It's been a great privilege to serve the people of Pennsylvania," Specter said to a round of applause. "And it's been a great privilege to be in the United States Senate, and I'll be working very hard for the people of the commonwealth in the coming months."

The proposals are unlikely to win over liberal Democrats who want the president to expand his plan to include a public option or Republicans whose unyielding opposition has forced Democratic leaders to consider passing the legislation through an unusual budget move that bypasses a filibuster.

The GOP proposals Obama has embraced reform the way states handle medical malpractice suits, reduce waste and abuse in the health care system, increase Medicaid reimbursements to doctors and expands health savings accounts.

Sestak says federal job was offered to quit race

Rep. Joe Sestak (D., Pa.) said yesterday that the White House offered him a federal job in an effort to dissuade him from challenging Sen. Arlen Specter in the state's Democratic primary.

The disclosure came during an afternoon taping of Larry Kane: Voice of Reason, a Sunday news-analysis show on the Comcast Network. Sestak would not elaborate on the circumstances and seemed chagrined after blurting out "yes" to veteran news anchor Kane's direct question.

"Was it secretary of the Navy?" Kane asked.

"No comment," Sestak said.

"Was it [the job] high-ranking?" Kane asked. Sestak said yes, but added that he would "never leave" the Senate race for a deal.

Still, Sestak's account was startling.

"Clearly, the offers are made," said Ross Baker, a Rutgers University political science professor who specializes in Congress. "When a White House wants to preempt a challenge, they'll dangle something. But it is almost never uttered."

Obama endorsed Specter at the White House and has raised money for him. Gov. Rendell has been vocal in calling Sestak's challenge harmful to the party, as has state chairman T.J. Rooney.

Indiana Sen. Evan Bayh announced Monday that he will not seek re-election this November, an unexpected decision that hands Republicans an opportunity for a pick-up in a year when Democrats are already defending several open Senate seats.
Bayh, calling his decision a "very difficult, deeply personal" one, said he had been discouraged by the intense partisanship on Capitol Hill and that he had no interest in running in November solely "for the sake of winning an election."

"I love working for the people of Indiana," he said. "But I do not love Congress."

Two Democratic senators and one governor announced their retirements earlier this month, and days later, the smart money has Ted Kennedy's Massachusetts Senate seat falling to the GOP for the first time in nearly 60 years. Suddenly, the Republicans are crowing and Democrats are trembling -- everyone says the Democratic Party is doomed in 2010.

What is the source of this breathless hysteria? Memories of the 1994 Republican midterm landslide. But everyone should take a deep breath: The 2010 midterms will not be a repeat of 1994. Why? Because almost everything we think we know about the 1994 election is wrong.

Let's look at the 1994 election. How was the GOP able to pick up 52 House seats and eight Senate seats to take control of Congress for the first time in over four decades? This was the second year of Bill Clinton's presidency, and his signature initiative -- healthcare reform -- had just failed. Although economists insisted the recession was over, unemployment remained high and wages were stagnant.

Wait! 2010 isn't like 1994 because Obamacare HASN'T failed yet?? That's the only difference?

Air America Goes Off the Air

Air America Radio is shutting down its operations after company files for bankruptcy.
(And this week just keeps getting better,...)

Air America Radio, a progressive radio network that once aired commentary from Al Franken and Rachel Maddow, said Thursday it is shutting down immediately.

The company founded in April 2004 said it ceased airing new programs Thursday afternoon and will soon file to be liquidated under Chapter 7 bankruptcy. It began broadcasting reruns of programs and would end those as well Monday night.

Air America said 10 consecutive quarters of declining ad revenue and the difficulty of making money on the Internet contributed to its financial woes.

"The very difficult economic environment has had a significant impact on Air America's business. This past year has seen a `perfect storm' in the media industry generally," the company said in a statement on its Web site.

The network had some 100 radio outlets nationwide.

Franken, a Democrat, hosted his own show from 2004 to 2007 before going on to become a U.S. senator from Minnesota last year after a close election. Maddow went on to host her own TV show on MSNBC.

Folks, it's worth repeating:
